If you accept “clean-fill” onto your property and if a statutory authority believes or suspects that the fill may be contaminated, under provisions within the Protection of the Environment Operations Act 1997, they have the power to issue a notice to you to take clean-up action. This could involve an investigation of the imported fill material to prove that the material meets the land-use criteria and can remain on the property.
